Social volunteer.
Buenos Aires, 06 December 2007 .-

The Legislature of the Autonomous City of Buenos Aires adopted as Law

Title I - General Provisions

Article 1 .- Aim. This law aims at the promotion and dissemination of social voluntary activities that are pursued in the area of the Autonomous City of Buenos Aires.

Article 2 º .- Definitions. A los efectos de la presente ley, se entenderá por: For the purposes of this Act, shall apply:
a. Social volunteer. Activities common good and general interest, welfare, social services, civic, educational, cultural, scientific, sports, health, development cooperation, safeguard the environment or other similar nature, carried out by volunteers in social framework of civil society organizations, without receiving any remuneration, salary or any financial compensation.
b. Organizations we are exercising social volunteerism. Persons of legal existence, public or private, nonprofit, whatever their legal form, engaged directly or indirectly in programs and / or projects having purposes or objectives oriented to the common good and general interest in developing the country or abroad, and have supported or not, grant or state sponsorship.
c. Social volunteers. Individuals who develop, for self-determination, in a free, unselfish, supportive and ongoing social volunteer work in civil society organizations, without receiving any remuneration, salary or any financial compensation.

Article 3 º .- Scope. They are not covered by this law of the voluntary isolated, sporadic, performed for family, friendship and good neighborliness and those activities whose implementation does not arise from a free choice or has arisen from a contractual, statutory or legal duty.Service provision in this law framed in the form of social volunteerism should be free and may never replace a paid job and presumably outside the scope of employment and social welfare.

Article 4 º .- Authority application. The Ministry of Social Development is the implementing authority of this Act.

Part II - Rights and Duties of Voluntary Social

Article 5 º .- Rights of the volunteer. Social volunteers will have the following rights:
a. Receive information on the objectives and activities of the organization indispensable to the development of the internship.
b. Receive the training required to carry on its business.
c. Be registered at the time of high and low for the organization, as determined by the regulation.
d. Have identification showing their status as a volunteer in the organization.
e. Obtain certificate of the training and record work performed.

Article 6 º .- Obligations of the volunteer. Social volunteers are required to:
a. Meeting the commitments to the organization in which they participate, accepting the goals and objectives of it.
b. Respect the constitutional and legal rights and dignity of the beneficiaries of the programs in which they operate.
c. Save the confidentiality of information received in the course of activities, where its disclosure would harm individual rights.
d. Participate in training to carry out the organization with the aim of improving the quality performance of activities.
e. Refrain from receiving any economic consideration for the beneficiaries of their activities.
f. Use appropriate and ethically accreditation and distinctive organization.
g. On termination of the activities, and as far as is practicable, reasonable time to give notice to the organization.

Title III-Rights and Obligations of Organizations

Article 7 º .- The organizations with the presence of volunteers should:
a. Be incorporated in the National Register of Organizations of the Government of the City of Buenos Aires (ROAC).
b. Comply with the voluntary commitments in the agreement on incorporation into the organization.
c. Provide resources to cover costs previously agreed incurred in the performance of voluntary activity.
d. Establish internal reporting systems and appropriate guidance to perform tasks that are assigned to volunteers.
e. Provide volunteer training required for the proper conduct of its activities.
f. Giving volunteers a credential that enables and identifies the development of their business.
g. Keep a record of ups and downs of volunteers who comprise the hours worked for the organization, and file the copy of the Common Basic Agreement
h. Bring a book initialed specifically designed to record reimbursements for volunteers to deliver, which shall contain: name and surname of volunteer identity, number of hours per week paid to the volunteer organization, and amount disbursed as reimbursement and concept of it. Also, the organization must keep the receipts evidencing the costs incurred by volunteers in carrying out the agreed activity and giving rise to the refund.

Part IV - Common Basic Agreement of Voluntary Social

Article 8 º .- Common Basic Agreement The organization, through its responsible social and each volunteer signed an Agreement of Voluntary Social Common Core.

Article 9 .- Terms of Accession. The terms of accession to the Common Basic Agreement shall be written in the form prior to commencement of activities between the organization and the volunteer social and should consider at least the following requirements:
a. Details identifying the organization.
b. Name and complete the volunteer.
c. Rights and responsibilities assumed by both parties.
d. Activities to be undertaken and the volunteer time devoted to giving the undertaking.
e. Start and end of events and causes and forms of disengagement by both parties duly notified.
f. Signature of the volunteer and the organization responsible for giving his assent to the mutual incorporation and the principles and objectives that guide the activity.
g. Commitment, if the organization so previously set for the receipt of reimbursements for expenses duly accredited by invoices, tickets or other legal instrument to effect incurred in the performance of voluntary activity. Such reimbursement in no case be considered remuneration.
The Common Basic Agreement will be instrumented in two specimens of the same tenor and for the sole purpose of complying with this law, one of which will be awarded to the volunteer.

Article 10 .- The conflicts that arise between volunteers and organizations in carrying out the activities of volunteers are settled in the competent court in accordance with the provisions of procedural rules.

Title V - Volunteer Building Measures

Article 11 .- The Government of the City of Buenos Aires, through the enforcement authority, develop programs of technical assistance and training for volunteer and implement information campaigns and recognition of volunteer activities through the means it deems appropriate .
También actuará de nexo para la articulación de las actividades de distintas organizaciones buscando la complementación entre las mismas. It will also act as a nexus for the coordination of the activities of various organizations for the complementation between them.

Article 12 .- The volunteers will enjoy the benefits established by regulation as a means of promotion, recognition and social value of voluntary action.

Title VI - Education Fraud Penalty

Article 13 .- The institution who uses volunteer as a way of fraud against the labor law and that the same Quedare demonstrated by final judicial decision, not seek or receive any benefit or allowance from the Government of Buenos Aires during a period of eighteen (18) months from the dictation of that sentence.

Transitional Provisions

Rules. The Executive Branch shall regulate this law within sixty (60) calendar days from its promulgation.

Deadline for appropriateness. The organizations that the entry into force of this law have volunteers must comply with the provisions therein within one hundred twenty (120) calendar days from its regulation.
